Terms of Service

§ 1 Scope

These Terms govern the use of the service VaultGate("Service"), provided by the operator named in the Legal Notice("Provider"). By registering, you accept these Terms.

§ 2 Description of Service

VaultGate is a trading journal and analysis tool for manual futures trading. The Service allows you to record, journal, analyse and optionally receive AI-generated summaries of your own historical trading data.

§ 3 No Financial Services, No Investment Advice

The Provider is expressly not a financial service provider under the German Banking Act (KWG) / WpIG and not a bank. The Service delivers:

  • NO investment advice within the meaning of § 1 (1a) KWG / MiFID II.
  • NO buy, sell, hold or sizing recommendations for specific financial instruments.
  • NO forecasts of future market movements.
  • NO promise of positive returns, no performance guarantee.

All texts, metrics and AI outputs shown in the Service are purely statistical evaluations of your own trading data that you have entered or imported. The decision to commit your own capital to the market is yours alone. Trading futures, options or CFDs carries the risk of total loss of the capital invested and may trigger additional payment obligations.

§ 4 AI-Assisted Analysis

At your explicit request, your pseudonymised trading metrics are processed by large language models (LLMs) to return natural-language insights. Details on providers, scope of data and third-country transfer: see the Privacy Policy. You can disable AI processing at any time in the settings; insights already generated remain stored in the Provider's database until you delete them.

AI outputs may contain factually incorrect, hallucinated or misleading content. The Provider assumes no warranty for the accuracy, completeness or fitness for a particular purpose of AI outputs.

§ 5 Registration and User Obligations

  • You provide accurate information when registering.
  • You keep your password secret and do not share it.
  • You do not use the Service for unlawful purposes.
  • You do not upload content that violates third-party rights (in particular no copyrighted third-party chart screenshots).

§ 6 Availability

The Provider aims for high availability but does not owe continuous reachability. Maintenance windows and force majeure remain reserved.

§ 7 Liability

The Provider is liable without limitation for intent and gross negligence as well as under the German Product Liability Act. In cases of slight negligence, the Provider is only liable for the breach of essential contractual obligations (cardinal duties) and limited to the damage foreseeable and typical for the contract.

No liability whatsoever is assumed for losses incurred by you through trading decisions — regardless of whether those decisions were influenced by the use of the Service or AI outputs. The decision to trade the markets is yours alone.

§ 8 Termination and Account Deletion

You may delete your account in the settings at any time. Upon deletion, all contractual relationships end; personal data will be removed as described in the Privacy Policy.

§ 9 Amendments

The Provider reserves the right to adjust these Terms. Material changes will be notified to you by e-mail or on the next login before they take effect. Without your renewed consent to the amended Terms, the Service cannot be used further.

§ 10 Final Provisions

German law applies. Place of jurisdiction is the Provider's registered seat insofar as the user is a merchant, a legal entity under public law or a special fund under public law, or has no general place of jurisdiction in Germany. The invalidity of individual clauses does not affect the validity of the remaining Terms.
